Summary: We will not investigate Miss X’s complaint that the Council failed to arrange suitable full-time education for her child. This is because her complaint is made late and I see no good reason to exercise discretion and consider it now.
The complaint
- Miss X complains that the Council failed to arrange suitable full-time education for her child.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate late complaints unless we decide there are good reasons. Late complaints are when someone takes more than 12 months to complain to us about something a council has done. (Local Government Act 1974, sections 26B and 34D, as amended)

- I considered information provided by the complainant and the Council.

My assessment
- Miss X complained to the Council in January 2024, after she said her child was excluded from attending school and the Council failed to arrange alternative education. The Council sent a final response to Miss X in April 2024 and advised she could escalate the matter to the Ombudsman.
- I will not investigate Miss X’s complaint because it is made late. I see no good reason why Miss X could not have complained to the Ombudsman in April 2024.
