Summary: We are issuing this report because the Council failed to comply with an agreed recommendation to provide one of the remedies from a previous complaint Mr X made to us.
Finding
The Ombudsman upheld the complaint and found fault causing injustice.
Recommendations
To remedy the injustice identified, the Council should:
- apologise to Mr and Mrs X for frustration they experienced due to its delays in carrying out Mr Y’s annual review; and
- pay Mr and Mrs X £200 to recognise the further frustration and uncertainty caused by its failure to comply with the agreed action following our final decision in October 2019.
- Within six months of the date of this report the Council should:
- review its processes to ensure it is carrying out annual reviews in line with statutory guidance;
- ensure it has suitable processes in place to make sure it is monitoring and acting promptly where an educational establishment fails to carry out annual reviews in line with statutory guidance; and
- ensure it has a suitable corporate process in place to make certain that all our recommendations are fully and promptly implemented.
