Oxfordshire County Council (25 007 905)
Statement Closed after initial enquiries Charging 06-Nov-2025
Summary: We will not investigate this complaint about whether Ms C’s son may have been eligible for healthcare funding sooner if the Council had contacted the health authority before it did. The local health authority is responsible for considering eligibility for healthcare funding for past periods of care where an individual has not been assessed. The health authority is better placed to consider the period of care in dispute.

Devon County Council (25 007 974)
Statement Closed after initial enquiries Special educational needs 06-Nov-2025
Summary: We will not investigate this complaint about the Council not providing a suitable school for Miss X’s child for September 2025. The Council issued an Education Health and Care Plan naming a school for the child for September 2025. This gave Miss X an alternative remedy it would have been reasonable to use by way of appeal to the Special Educational Needs and Disability Tribunal. Following her subsequent unsuccessful application to a school in another area, it would be for her to appeal to the same Tribunal against any refusal of the Council to name that school on her child’s Plan.

Hartlepool Borough Council (24 017 610)
Statement Upheld Special educational needs 05-Nov-2025
Summary: Mr F complained the Council delayed reviewing his adult son’s education, health and care plan and failed to secure his special educational needs provision. We found delay which caused Mr F’s son uncertainty but on balance of probabilities did not cause loss of special educational needs provision. The Council has agreed to apologise.
