Summary: We cannot investigate this complaint about the Council’s actions leading to a decision to place Miss X’s child for adoption. This matter is not separable from the question of where and with whom the child should live, which only a court can decide.
The complaint
- Miss X said the Council conducted her case very unfairly. She said her child was placed and about to be adopted.

- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.

Final decision
- We cannot investigate Miss X’s complaint because the matter she complains of is inextricably linked with a court process. At the first approach by either party to a court, we are legally debarred from considering matters that are or could reasonably be raised in court, both during the proceedings and afterwards.
