    Summary: The Council was at fault in its handling of Miss X's homelessness. The Council's delay finding accommodation when Miss X had to leave her private tenancy and when a review found her temporary accommodation was unsuitable was the result of service failure and despite the Council's efforts. The Council's failure to properly assess the needs of Miss X's Disabled child, its poor communication and complaint handling were fault. The Council has agreed to apologise and make payments to Miss X in recognition of the injustice caused and act to improve its services.

To remedy the injustice caused the Council has agreed to apologise to Ms W and repair the defective road drainage.

    Summary: Ms X complains about the quality of care provided for her mother, Mrs Y, by Asus Care UK Limited. The care provider is responsible for the fact one of its care worker’s was not in a fit state to care for Mrs Y for four days. It needs to refund Mrs Y what she paid for those four days. The care provider also failed to deal properly with the introduction of a new contract, which caused avoidable distress to Ms X. It needs to apologise and make a symbolic payment for the distress caused.

We found the Council’s failure to issue a new EHC Plan as ordered by the SEND Tribunal is fault. This fault has caused Miss X and Y an injustice.

The Council has agreed to apologise, to make a mileage allowance payment for Mrs X for the days Y attended the school and to make a symbolic payment to recognise Mrs X’s distress. The Council has also agreed to carry out some staff training and to review its school transport policy.
