Summary: We cannot investigate this complaint about care provision. This is because we can only consider complaints about care provision from the person receiving the care or a person making a complaint on their behalf.
The complaint
- X complained that a Care Provider had decided to house a person in an unsuitable property. They said that person should have been housed somewhere else, more suitable, and they continually suffer unnecessary disruption because they live nearby. X wants the Care Provider to move them somewhere else.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate. The law says we may investigate complaints about matters connected with adult social care only.
- We may investigate complaints made on behalf of someone else if they have given their consent. (Local Government Act 1974, section 26A(1), as amended)
