The Ombudsman's final decision:
Summary: We cannot investigate Mr B’s complaint about allegations made about him. This is because the actions complained about are not in connection with the provision of adult social care so are not within our jurisdiction.
The complaint
- Mr B says the Care Provider falsely accused him of following staff, did not get in touch with him to make a statement regarding his version of events and contacted his employer. Mr B says the Care Provider jeopardised his employment and wants the staff members making the allegations against him dismissed.

My assessment
- Although the Care Provider is within our jurisdiction the function being complained about, namely allegations that Mr B followed staff and the Care Provider failed to consider his version of events, falls outside our role under part 3A Local Government Act 1974. Mr B was not receiving care and support from the provider and our powers are limited to investigating actions in connection with the provision of adult social care services as defined in law.
Final decision
- We cannot investigate Mr B’s complaint because the actions complained about are not in connection with the provision of adult social care.
