Summary: We cannot investigate this complaint about information being passed to Mrs Y’s employer during the Care Provider’s whistleblowing investigation. This is because the complaint is not related to action taken for the provision of adult social care.
The complaint
- Mrs Y complains the Care Provider, during its internal whistleblowing investigation, spoke to her employer and made an allegation about her professional conduct.
- Mrs Y says the resulting investigation her employer carried out, caused her distress and inconvenience.
The Ombudsman’s role and powers
- We may only investigate a matter about an adult social care provider where the matter relates to action taken by it in connection with the provision of adult social care. (Local Government Act 1974, section 34B)
