  • Liverpool City Council (24 003 213)

Statement Upheld Special educational needs 01-May-2025

Summary: Miss B complained about the Council’s handling of her daughter’s Education, Health and Care Plan. We have found the Council at fault for a delay in completing the annual review held in May 2023 and its failure to consider a request for a personal budget in this time. These faults have caused Miss B distress and uncertainty. The Council has agreed to apologise and make symbolic payments to Miss B and issue a reminder to its staff to ensure they are aware of the Council duty to respond to personal budget requests.

  • Coventry City Council (25 000 016)

Statement Closed after initial enquiries Council tax 01-May-2025

Summary: We will not investigate this complaint that the Council did not notify the Valuation Office Agency of the change in Mr X’s property from commercial to domestic. This is because there is insufficient evidence of fault by the Council.

  • Birmingham City Council (25 000 170)

Statement Closed after initial enquiries Refuse and recycling 01-May-2025

Summary: We cannot investigate Mrs X’s complaint about missed refuse collections. This is because the issue stems from industrial strike action by the Council’s refuse collection crews and is a matter which affects all or most of the people in the Council’s area.

  • Brighton & Hove City Council (25 000 457)

Statement Closed after initial enquiries Child protection 01-May-2025

Summary: We will not investigate this complaint about the conduct of a Council social worker. This is because we would achieve nothing significant by doing so.

  • Birmingham City Council (25 000 482)

Statement Closed after initial enquiries Highway repair and maintenance 01-May-2025

Summary: We will not investigate Mr X’s complaint about a highway disrepair issue he says has resulted in damage to his car. This is because it would be reasonable for Mr X to take the matter to court.

  • London Borough of Islington (25 001 626)

Statement Closed after initial enquiries Other 01-May-2025

Summary: We cannot investigate Mr B’s complaint about his property being damaged by the actions of the Council tenant at the adjoining property. This is because we cannot investigate complaints about the management of social housing by a council acting as a social landlord.

  • Southend-on-Sea City Council (25 001 658)

Statement Closed after initial enquiries Planning applications 01-May-2025

Summary: We will not investigate Mr B’s complaint about incorrect planning advice he received from the Council. This is because an investigation would not add to the investigation undertaken by the Council.

  • Hampshire County Council (24 010 249)

    Statement Upheld Charging 30-Apr-2025

Summary: Ms D complained the Council sent her a bill for her late grandfather’s (Mr X) care, eight months after he died and after his estate was distributed. Based on current evidence, the Council is at fault for poor communication which caused a delay in it being notified of Mr X’s death. This caused Ms D emotional distress and will potentially cause her financial distress. I have recommended the Council asks Ms D for information about the debt and estate so it can reconsider the amount. I have also recommended the Council offers Ms D a payment plan for any remaining debt.

  • Cumberland Council (24 019 271)

Statement Closed after initial enquiries Council tax 30-Apr-2025

Summary: We will not investigate this complaint about the Council’s handling and enforcement of recovery action for Mr X’s unpaid council tax debt. This is because the complaint involves a disagreement about how the relevant law should be interpreted, and this would best be for a court to decide.
