Summary: Mrs H complained the Council’s Adult Social Care and Special Educational Needs and Disabilities Teams have not worked well together in providing her son with the support he needs. There has been delay, inaccuracies and a refusal to increase support. We uphold the complaint due to delays in assessments, approving direct payments, joint working and providing overnight respite. The Council has agreed to our recommendations for ways to remedy the injustice.

Summary: Mr X complained the Council did not complete a reassessment of his housing allocation following new medical evidence. We find the Council at fault for the time taken to complete a reassessment, causing distress and uncertainty. The Council will apologise and remind relevant staff that, when a decision is delayed pending further enquiries, it should provide a clear update explaining the reason for the delay and the expected next steps.

Summary: Miss Y complained about how the Council delayed providing her mother, Mrs X, with a care package, respite care fees and with aids and adaptations to meet her needs. There were some faults by the Council which caused injustice to Mrs X and Miss Y. The Council will take action to remedy the injustice caused.

Summary: Mrs X complained about the Council’s actions relating to her son’s education. We found fault because the Council took too long to issue his Education, Health and Care Plan. It also failed to appropriately consider whether it owed him a duty to provide alternative education when he could not attend school. This caused Mrs X avoidable distress, frustration and uncertainty. It also meant her son missed out on education. The Council has already offered Mrs X payments to remedy missed education. The Council will now offer increased payments for missed education, offer Mrs X its suggested payment for the delay in completing her son’s plan and apologise to her.

Summary: Mr X complains about the way the Council dealt with his housing situation after his relationship with his ex-partner ended and they remained at the same property causing distress. We have ended our investigation as we cannot achieve the outcome Mr X is seeking as his current living arrangements have now been approved by the courts.

Summary: The Council was at fault for not meeting Mr Y’s assessed care and support needs when it housed him in unsuitable accommodation. The Council was also at fault for its poor communication and complaint handling. It will apologise and make a symbolic payment to Mr Y to acknowledge the distress caused by his unmet care needs and the avoidable frustration and uncertainty he was caused by its faults. It will also take action to prevent the recurrence of the same faults.

Summary: Mrs X complained the Council failed to provide a full time education for her daughter, Y, since October 2024. She also complained the Council failed to provide the provision as set out in Y’s Education, Health and Care (EHC) Plan. Mrs X said this caused the family distress and Y missed education and plan provision. The Council was not at fault.

Summary: Mr X complained about the Council’s failings when claiming benefits as his appointee and when responding to his complaint. We found fault with the Council. This fault caused injustice to Mr X. The Council has agreed to apologise to Mr X and make a payment to recognise his financial loss. The Council has also agreed to carry out some service improvements.

Summary: We found fault on Mrs Y’s complaint about the Council failing to provide her son with appropriate provision under his Education, Health and Care plan. It failed to show it monitored whether he received the stated provision and satisfied itself he had. It also failed to make and retain records showing it actioned, monitored, and reviewed alternative provision for him. The Council agreed to send an apology, make a symbolic payment, and remind relevant officers of actions needed.
