Summary: Ms X complained the Council failed to ensure her child D received a suitable education or had their special educational needs met. Ms X also said the Council failed to make reasonable adjustments for her as someone with a disability, so she could engage fully in its processes. There was fault by the Council which meant D did not receive suitable education or support for their special educational needs. It also caused avoidable distress for D and for Ms X. The Council agreed to apologise, agree reasonable adjustments it will make for Ms X, ensure suitable education and special educational support is in place for D without delay, and pay a financial remedy. It will also review relevant procedures, issue reminders to its staff, and ensure our findings are considered as part of its SEND Improvement Strategy.

Section 26(6)(a) of the Local Government Act 1974 says we have no jurisdiction to investigate where someone has used a right of appeal, reference or review to a Tribunal about the same matter.

There was no fault in the Council’s provision to Mrs X’s son until January 2023 when the Council failed to provide alternative provision. Summary: Mrs D complained that the Council failed to provide suitable carers to meet her needs, failed to communicate with her properly about the difficulties in sourcing carers, and made inappropriate suggestions for alternative care. It also failed to deal with Mrs D’s complaint about the issue in accordance with its complaints procedure, causing a long delay and increasing Mrs D’s distress. We have found fault with the actions of the Council causing injustice to Mrs D. The Council has agreed to pay Mrs D £500 and improve its complaint handling for the future.

Summary: Mrs M complains about the Council's handling of her application for transport for her son B's post-16 education. I uphold Mrs M’s complaints about the lack of information on the Council’s website and in its policies about payments instead of transport, and delay by the Council making decisions. The Council’s undertaking to improve its website and policies, and its apology for the delay, are a suitable remedy. I do not uphold Mrs M’s complaint about the mileage rate used by the Council or its decision not to pay for her time. There is no fault in these decisions. The Ombudsman cannot question decisions made without fault.
