    Summary: Mrs X complains about a lack of enforcement action by the Council after a developer removed an understory that provided privacy to her property. We have concluded our investigation having made a finding of fault by the Council. We found there were significant delays in the process which have impacted the time taken to find a resolution and restore privacy to Mrs X’s property. The Council have accepted our recommendations.

    Summary: X complained about the Council’s failure to act in a timely and effective manner, which led to development near their home becoming immune from enforcement action. The Council accepted its poor record keeping and delay caused X avoidable time, trouble and distress. The Council agreed to improve its offer to put matters right by paying X £600 in recognition of the injustice arising from its fault.

    Summary: Mr X complained the Council failed to ensure the developer complied with planning conditions in relation to demolition of properties at the end of his street. This led to a large amounts of dirt, noise and disruption on his street from large vehicles accessing the site. There is no evidence of fault in the way the Council responded to Mr X’s report of breach of planning control at a site near his home.

    Summary: Mr and Mrs Y complain about the Council’s failure to pursue timely enforcement action against the unauthorised stationing of two mobile homes near their property. In our view, the presence of the mobile homes does not significantly impact on Mr and Mrs Y’s residential amenity. However, there is some evidence of fault in how the Council corresponded with Mr and Mrs Y about the matter. This caused injustice which the Council will remedy with the actions listed at the end of this statement.
