    Summary: We have ended our investigation into Mr X’s complaint about the Council’s failure to provide adequate support for his disabled children and will not investigate the Integrated Care Board (ICB) as there is nothing more we could achieve. The Council has already offered Mr X a payment to reflect delays in completing assessments and Mr X’s complaint has been dealt with through the statutory complaints process. This included input from the ICB.

    Summary: Mr X complained about the care provided to his brother, Mr Y, by several health and social care organisations. We found fault by two councils as there was significant confusion surrounding how Mr Y’s care should be funded. We also found fault with the care provided to Mr Y when he was resident in a care home. The organisations involved agreed to apologise to Mr X and pay him a financial remedy in recognition of the impact of this on fault on him. They also agreed to take action to prevent similar problems occurring for others.

    Summary: Mrs B complains about the ICB’s funding of her disabled son F’s care. She says the ICB did not fund enough care hours, so the Council paid for extra overnight care which meant it would not increase the respite hours for her and her son. Mrs B says this had a negative impact on her and her husband’s mental health and they lost out financially. The organisations acted with fault as they did not assess F’s needs for care and support in a holistic and multi-agency way in line with relevant guidance. They also failed to communicate with each other effectively. This caused preventable distress and inconvenience to Mrs B. The organisations have agreed to apologise for the impact of these failings on Mrs B, pay Mrs B a financial remedy, and take action to improve their processes when assessing Children’s Continuing Care.

    Summary: Mrs B complained about the health and social care support provided by the Council and the NHS Trust after she removed her late husband, Mr B, from a respite placement and took him home. She also complained about the way the former Clinical Commissioning Group (CCG and now Integrated Care Board) considered whether
    Mr B was eligible for healthcare funding. She said the events had adverse impact on her and her husband. We found the Council and the Trust failed to work together to complete a holistic assessment and this led to a disjointed approach when providing health and social care support. As a result, it is likely Mrs B experienced increased carers strain and avoidable worry and distress. There was fault in the way the CCG considered Mr B’s eligibility for healthcare funding, but it acted to put things right. The Council and the Trust have agreed to our recommendations and will apologise to Mrs B for the lack of joint working, make an acknowledgement payment and improve.

    Summary: Mr G complained about the care and support provided to his late brother, Mr T, by the Council and the Home when dealing with his breathing and providing social stimulation. He also complained about the way the Integrated Care Board (the former clinical commissioning group) considered Mr T’s eligibility for healthcare funding. We did not find fault in the care and support arrangements provided by the Council and the Home. We found no evidence of fault in the way the former clinical commissioning group considered Mr T’s eligibility for healthcare funding.

    Summary: Mr B complained about the actions of a Care Provider because he says his late mother’s rings went missing in one of its nursing homes. He also said the Council did not do enough to investigate the matter. We did not find fault by the Council. The Care Provider failed to follow its procedures as it did not ensure a record of belongings form was signed by its staff and Mr B’s mother. This is likely to leave Mr B with uncertainty about the whereabouts of his mother’s rings. The Care Provider has agreed to our recommendations and will apologise to Mr B and improve its procedures to ensure residents belongings are properly recorded, agreed, and signed by the resident or their representative.

    Statement Not upheld Assessment and funding 31-Aug-2022

    Summary: We found no fault by a Council and ICB with regards to how they assessed Mrs Y’s needs following her discharge from hospital. However, we found fault with the Council’s complaint response which incorrectly advised Mrs Y’s son that a Continuing Healthcare Checklist had been completed when it had not. The Council will apologise for the distress this caused.
