  • Kent County Council (21 008 142)

Statement Upheld Highway repair and maintenance 18-Mar-2022

Summary: Mr X complains about the way the Council responded to and dealt with his reports of flooding at his property caused by a blocked drain near to his home. We found no evidence of fault in the way the Council responded to Mr X’s concerns about the blocked drain. We found fault as the Council delayed in responding to Mr X’s request for the Council to install a road gulley near to his property. The Council has already apologised to Mr X for the delay which is a suitable remedy in this case. So, we have completed our investigation.

  • London Borough of Barnet (21 015 610)

Statement Closed after initial enquiries Highway repair and maintenance 15-Mar-2022

Summary: We will not investigate this complaint that the Council did not follow the correct authorisation process when setting the height of replacement speed bumps. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. It is reasonable to expect the complainant to have contacted us sooner, and there is not enough evidence that the alleged fault has caused the complainant a significant injustice.

This is because it would be reasonable for the complainant to seek a remedy through the courts if he believes the Council are liable for the damage. We will not investigate other matters which have not first been through a council’s internal complaints process.
