  • Bournemouth, Christchurch and Poole Council (21 006 467)

    Statement Not upheld Other 04-Feb-2022

Summary: Mr X complained about the Council’s failure to make planning and enforcement decisions in relation to a site near his home. We did not investigate this complaint further as it is unlikely to result in a meaningful outcome.

  • Lewes District Council (21 003 413)

    Statement Upheld Other 03-Feb-2022

Summary: Mr X complained about Council’s decision to discharge a planning condition for surface water drainage without properly consulting with the flood authority. We have found the Council was at fault for not doing so, however this did not affect the outcome because retrospective approval for the scheme was given. We are satisfied the injustice to Mr X has already been remedied by the Council subsequent actions, including an apology to Mr X for the failure to properly consult.

  • Teignbridge District Council (21 006 558)

Statement Closed after initial enquiries Other 02-Feb-2022

Summary: We will not investigate this complaint about how the Council dealt with a planning application for a development near the complainant’s homes. This is because we are unlikely to find fault.

  • East Riding of Yorkshire Council (21 005 077)

    Statement Not upheld Other 31-Jan-2022

Summary: Mr C complained about the Council removing supports from his fence in 2014, which he said caused damage to the fence. We decided we could not investigate the complaint because the events happened more than 12 months ago, Mr C could have complained about them earlier and it was reasonable for him to have challenged the Council’s decision through the courts.

  • Waverley Borough Council (21 014 201)

Statement Closed after initial enquiries Other 28-Jan-2022

Summary: We will not investigate this complaint about the Council’s decision that he is liable to pay Community Infrastructure Levy. This is because the Valuation Office Agency is the body set up in law to consider these matters and it would be reasonable to expect Mr X to pursue the family’s right of appeal.

  • South Hams District Council (21 008 251)

Statement Closed after initial enquiries Other 27-Jan-2022

Summary: We will not investigate this complaint about a conflict of interest in the Council’s consideration of the complainant’s planning application and their reports of breaches of planning control. There is not enough evidence of fault to justify an investigation.

  • Gravesham Borough Council (21 000 354)

Statement Closed after initial enquiries Other 21-Jan-2022

Summary: We will not investigate this complaint about the Council’s 2014 Local Plan. This is because this is a late complaint and there are no good reasons for us to investigate it now.

  • Cheshire East Council (21 006 005)

    Statement Not upheld Other 14-Jan-2022

Summary: Mrs X complained about the Council’s failure to take planning enforcement action against her neighbours. We ended our investigation as it was unlikely to result in a finding of fault or a meaningful outcome for Mrs X.

  • West Berkshire Council (21 014 045)

Statement Closed after initial enquiries Other 14-Jan-2022

Summary: We will not investigate this complaint about data protection issues related to a planning application. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate as there is another body better placed to deal with the complaint.

  • Breckland District Council (21 013 219)

Statement Closed after initial enquiries Other 13-Jan-2022

Summary: We will not investigate this complaint that the Council included an unenforceable condition on a planning permission. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. There is not enough evidence of fault, and any injustice to the complainant is not significant enough, to justify our continued involvement.
