Summary: Miss X complained about how the Council handled her complaint about her neighbours burning items in their garden. She said the fumes negatively affected her family’s sleep and heath. The Council was at fault for its poor communication and delays in acting on the evidence Miss X provided. The Council admits a failure in service. It has agreed to apologise, make a financial payment and provide a better service to remedy Miss X’s injustice.

Summary: Mr C complains the Council has failed to issue an abatement notice for nuisance from odour from a nearby waste and recycling site. Mr C also complains about the way the Council responded to his information request. We have ended our involvement as Mr C has an alternative legal remedy and we consider the actions the Council has already taken in relation to the way it responded to his information request provide a suitable remedy for the remaining element of the complaint.

Summary: Mr X complains about issues resulting from sea defence work carried on the beach close to his home. He also complains about the noise during the construction work. We will not investigate this complaint because the Council is not responsible for the work, which was commissioned by another authority. Nor will we investigate the remaining concerns as we cannot achieve the outcome Mr X is seeking which is significant financial compensation.
