Statement Closed after initial enquiries Other 24-Mar-2022

Summary: We will not investigate this complaint about what information the Council holds and provides about enforcement cases relating to advertising displays. This is because her complaint relates to an old case she was connected with and there is no worthwhile outcome an investigation would achieve.

  • East Devon District Council (21 007 341)

    Statement Upheld Other 23-Mar-2022

Summary: Mrs X complains the Council has failed to take sufficient action to stop a resident from feeding birds which is causing a nuisance. The Council is at fault as its investigation drifted. This is because it did not consider if the investigation should be carried out by its Environmental Health Team when its Housing Management Team could not progress the investigation. This caused frustration and uncertainty to Mrs X. The Council has agreed to remedy this injustice by apologising to Mrs X and drawing up an action plan to ensure its investigations do not continue to drift.

Statement Closed after initial enquiries Other 21-Mar-2022

Summary: We will not investigate this complaint about the Council’s engagement with a community group of which Mr X is a member. This is because it is too late to consider past events now and because we are unlikely to find evidence of fault with the Council’s current position sufficient to warrant an investigation.

Statement Closed after initial enquiries Other 18-Mar-2022

Summary: We will not investigate this complaint about wrongly being issued with a fixed penalty notice for incorrect waste disposal. This is because the complainant can raise their defence in the magistrates court under the penalty notice enforcement procedure.

  • Torbay Council (21 018 145)

Statement Closed after initial enquiries Other 18-Mar-2022

Summary: We will not investigate Ms B’s complaint that she was injured when using a public toilet. This is because the courts are in the best position to decide personal injury complaints.

Summary: Mr X complained about the conduct of civil enforcement officers acting on behalf of the Council in April 2021. We cannot say if the civil enforcement officers acted appropriately on the day, however we have found fault with their administrative practice. The Council agreed to remedy the injustice this caused to Mr X.
