The Council has caused injustice to Mrs X for which we recommend an apology and some service improvements.

    Summary: Mrs X complained about the Council’s actions in respect of the elective home education which she is providing to her son. We are discontinuing our investigation because a group of parents have leave to pursue a judicial review of the Council’s policy and procedures. Mrs X’s complaint is inextricably linked to this legal action.

    Summary: Mrs X complained about the Council’s failure to provide her son, D, with suitable education for several months, including support for his special educational needs. The Council already accepted it was at fault for some of this time, apologised and offered a financial payment to remedy the injustice caused. We have also found the Council was at fault for the earlier period because it should have been aware that D was unable to attend school for medical reasons. To remedy this injustice, the Council has agreed to make an additional payment to Mrs X.

    Summary: Mr C complains the Council failed to fulfil its duty to ensure his daughter (D) had access to full time education. Mr C says this resulted in a loss of education for his daughter and additional difficulties and distress to her and his family. We have found delay by the Council in arranging education provision but consider an apology and payment provides a suitable remedy.

    Summary: We have discontinued our investigation into Ms X’s complaint that the Council failed to provide adequate educational and special educational provision for her son. This is because Ms X had appeal rights to the Special Educational Needs and Disability Tribunal which she exercised.

She also said the Council failed to provide the provision outlined in the EHCP. The Ombudsman has found fault by the Council which has caused D to miss out on special educational provision. The Council will apologise, make a financial payment and service improvements.

    Summary: Miss X complained the Council failed to investigate her concerns about safeguarding of her son, failed to provide support required by her son’s EHCP and failed to provide an education while her son was not at school. We found there was no fault in regard to the safeguarding issue. However, the Council were at fault for not providing education and EHCP provision. There was also fault in the way the Council handled Miss X’s complaint.
