    Summary: Mr X complained about delay by the Council when arranging replacement cot sides for his disabled son’s bed and related matters. We have found the Council to be at fault. To remedy the injustice caused, the Council has agreed to apologise and make a payment to Mr X for the distress and his time spent dealing with the matter. The Council has already taken action to improve the ordering process that should prevent a similar situation happening again.

Mrs Y also complains about how the Council handled her complaint. The Ombudsman finds fault with the Council for delaying an assessment for disability aids, and for not considering Mrs Y’s complaint under the statutory complaints process. The Ombudsman does not find fault with the Council for how it carried out a Child and Family assessment on Child A. The Council has agreed to consider a remedy for the injustice to Child A and service improvements.

    Summary: Mrs L complains about the actions of Kingston upon Hull City Council and NHS Hull Clinical Commissioning Group in relation to provision for her disabled sons M and N, during the COVID-19 pandemic. We find no fault in these actions. There was poor communication and fault in complaint handling which caused Mrs L time and trouble. The Council has agreed to make a payment to her to remedy this. The Council and CCG have agreed to review their complaint handling procedures.

The Council agreed to apologise to Mrs X for the distress and uncertainty this caused. It agreed to arrange and hold a stage 3 review panel within one month of the final decision.

The Council apologised, agreed to undertake a further assessment, overseen by a senior manager, and backdate any support offered. The Council has apologised for delays in its complaint response and offered a symbolic payment for Mr and Mrs P’s time and trouble. This is a satisfactory outcome.

The complaint took too long to complete the complaints process and the consideration failed to properly remedy the complaints that were upheld. The Council will take the action detailed in this decision statement to recognise the injustice Ms B was caused by these failings.
