    Summary: Mr B complains the Trust refused to detain his father, Mr C, in hospital. The Trust properly considered whether to detain Mr C. Mr B also complains the Council did not offer Mr C a placement in a care home. Mr C did not want to go into a care home but preferred to be at home with his wife. There is no fault.

    Summary: Mrs G complained about funding decisions affecting her late aunt, Mrs B’s, residential care. We have not upheld the complaints about Basildon and Brentwood Clinical Commissioning Group or about Essex County Council’s actions relating to free aftercare. We have upheld some of Mrs G’s complaints about the way the Council provided information about Mrs B’s care arrangements. The faults caused Mrs G avoidable time, trouble and frustration. The Council accepted our recommendation of an apology and financial remedy for Mrs G. We have therefore completed our investigation.

    Summary: We found a Trust failed to appropriately assess and record the needs of a young woman with entitlement to aftercare services under Section 117 of the Mental Health Act 1983 before discharging her into the community. The Trust will apologise to the complainant and pay a financial remedy in recognition of the impact of this fault on her. The Trust, Council and CCG will also review relevant policies and procedures to prevent similar problems occurring in future.

    Summary: We found fault with the support a Trust provided to a man with complex care needs and his parents. We also found fault by a Council in terms of the handling of the Mental Health Act Assessment process by an Approved Mental Health Practitioner acting on its behalf. The Council and Trust will apologise to the complainants and pay a financial sum in recognition of the distress caused to them by this fault. They will also take action to prevent similar problems occurring in future.

    Summary: The Ombudsmen investigated and upheld an earlier complaint about charging for accommodation which should have been free under section 117 of the Mental Health Act 1983. We have now investigated a complaint about the Council, NHS Trust and NHS Clinical Commissioning Group failing to carry out actions agreed during the earlier investigation. We have upheld the complaint. We have also found that an estimated 57 other patients may not have up-to-date section 117 aftercare plans. The organisations accept our recommendations, so we have completed our investigation.
