Summary: Mr X complained about the Council’s waste collection service. He also complained about the Council taking recovery action against him when he withheld a portion of his council tax because he carried out his own waste disposal. The Ombudsman should not exercise his discretion to investigate this complaint. This is because the incident with the waste contractors took place in 2017 which is outside the normal 12-month period for receiving complaints. There is insufficient evidence of fault in the council’s actions related to council tax recovery.
