    Summary: The Ombudsman found no fault by the Council on Mr G’s complaint of it failing to properly investigate and take enforcement action against 3 venues for noise nuisance. The evidence shows the Council investigated and acted on his reports. Nor am I satisfied the Council gave him inaccurate information as claimed.

    Summary: The Council mismanaged Miss B’s expectations when she raised a noise nuisance complaint. An officer spoke to Miss B in a way which she found upsetting. The Council has apologised to Miss B for the impact its actions had on her and undertook to provide training to its officers on these issues. The Council has taken appropriate action to acknowledge the impact of its fault on Miss B and to improve future service. The Ombudsman makes no further recommendations.

    Summary: Mr X complained about an incomplete noise survey conducted by the authority following his concerns about noise from a nearby recycling centre. I have stopped investigating this complaint and uphold Mr X’s complaint. The authority offered to conduct a new survey which has resolved the outstanding issue and no further action by the Ombudsman is needed.

    Summary: Ms B complains about the Council’s response to requests made over several years that it tackles noise from a local business. We do not fault the Council for its judgment that it cannot take action to prevent the noise Ms B complains about. However, we do find the Council at fault for poor customer service causing Ms B unnecessary time, trouble and frustration. The Council accepts this finding and at the end of this statement we explain the action it has agreed to take to remedy that injustice.

    Summary: Mr B complains about the Council’s handling of his noise and pollution complaints about an industrial premises near his home. The Council has been unable to gather evidence to assess the impact of the disturbance on Mr B. The Ombudsman cannot make a finding of fault when Mr B has declined to engage in the Council’s usual procedure. The Council’s communication with Mr B could have been clearer but this has not caused significant injustice to warrant a personal remedy. The Council has agreed to review its procedure to ensure this accurately reflects the statutory guidance for Environment Agency permitted sites.
