  • Somerset West and Taunton Council (19 007 196)

Statement Closed after initial enquiries Enforcement 21-Oct-2019

Summary: The Ombudsman will not investigate Mr X’s complaint about the landscaping scheme for a nearby sports building. There is not enough evidence of fault by the Council in the way it dealt with the landscaping matter, or of sufficient injustice caused to Mr X, to warrant an Ombudsman investigation.

  • London Borough of Barnet (18 001 892)

    Statement Upheld Enforcement 15-Oct-2019

Summary: Mrs D complains the Council has failed to take enforcement action against breaches of planning permission next to her property. The Ombudsman has found was fault causing injustice. The Council has agreed to apologise and take action without further delay.

  • Peterborough City Council (19 001 579)

    Statement Not upheld Enforcement 11-Oct-2019

Summary: The Council has properly investigated a breach of planning permission; it is considering an amended planning application to address the breach. The Council has no control over the amenity impact from a stairwell, as it is at a development that has been granted permitted development rights by the Government. It does have an impact on Ms B, but the Council has no powers to act. The conservation area and locally listed buildings provide the Council with no extra powers to help Ms B. The Council could have dealt better with Ms B’s complaint, but I find this did not cause a significant impact and was a minor issue.

  • Broadland District Council (19 008 462)

Statement Closed after initial enquiries Enforcement 11-Oct-2019

Summary: Mrs X complains that the Council refuses to take planning enforcement action against her neighbour’s fence. The Ombudsman will not investigate this complaint because there is no evidence of fault by the Council.

  • North Norfolk District Council (18 019 836)

    Statement Not upheld Enforcement 09-Oct-2019

Summary: Mr X complains the Council was at fault in the way it responded to his complaints about a breach of planning control for a landscaping scheme at a nearby development. The Ombudsman has found no evidence of fault in the way the Council considered these matters.

  • London Borough of Waltham Forest (18 005 800)

Statement Closed after initial enquiries Enforcement 08-Oct-2019

Summary: The Ombudsman will not investigate Ms B’s complaint about the way the Council has dealt with her reports of potential planning and building control breaches. Further consideration of the complaint is unlikely to find the Council’s decisions were affected by fault.

  • Shropshire Council (18 016 272)

    Statement Not upheld Enforcement 08-Oct-2019

Summary: Ms C complains about how the Council dealt with development next door to her home which has an impact on her amenity. The Ombudsman finds no fault with the Council’s actions in this matter.

  • Redcar & Cleveland Council (18 016 412)

    Statement Not upheld Enforcement 08-Oct-2019

Summary: The Ombudsman will not investigate this complaint about the Council deciding not to take enforcement action against the change of use of land to a car park. This is because the complaint is late, and it is reasonable to expect the complainant to have contacted the Ombudsman within 12 months of becoming aware of his concerns about the use.

  • Hinckley & Bosworth Borough Council (19 007 694)

Statement Closed after initial enquiries Enforcement 08-Oct-2019

Summary: The Ombudsman will not investigate Ms X’s complaint about the Council’s handling of matters relating to the removal of hedgerows in an area she enjoys walking. This is because it concerns events too far in the past to be investigated now and an investigation is unlikely to lead to the outcome Ms X seeks.

  • North Lincolnshire Council (19 007 664)

Statement Closed after initial enquiries Enforcement 07-Oct-2019

Summary: The Ombudsman will not investigate this complaint about how the Council investigated a possible breach of planning control. This is because it is unlikely he will find fault by the Council and the complainant has not been caused injustice.
