  • Newark & Sherwood District Council (19 009 360)

Statement Closed after initial enquiries Refuse and recycling 25-Oct-2019

Summary: Miss X complained the Council wrongly refused to empty her recycling bin when it claimed unauthorised materials were placed in the bin. We will not investigate this complaint. It is unlikely that further investigation will lead to a finding of fault or a meaningful remedy for Miss X, and the injustice Miss X says she experienced is not significant enough to warrant our involvement.

  • Thanet District Council (18 013 264)

Statement Upheld Refuse and recycling 25-Oct-2019

Summary: Mrs B complained about the Council’s recurrent failure to collect rubbish from eight bin stores on a new development. On the evidence available we find fault with the Council for failing to communicate the source of the problem to the development company or seek a long-term solution. The Council has agreed to monitor the collections over eight weeks, record the reasons for non-collections and meet with Mrs B at the end of this period to discuss a long-term solution.

  • Eastbourne Borough Council (19 007 412)

Statement Closed after initial enquiries Refuse and recycling 25-Oct-2019

Summary: The Ombudsman will not investigate Ms B’s complaint about a delay by the Council in replacing a missing bin. The Council has now replaced the bin, apologised to Ms B and accepted it should have kept her informed. There was no significant injustice to Ms B and further consideration of the complaint would not achieve any more for her.

  • Middlesbrough Borough Council (19 008 736)

Statement Closed after initial enquiries Refuse and recycling 25-Oct-2019

Summary: The Ombudsman will not investigate Ms B’s complaints the Council’s bins are too large to fit in her bin store, her bin was stolen, and the Council has asked her to pay £15 to replace it. Further consideration of the complaint is unlikely to find fault by the Council causing a significant personal injustice to Ms B.

  • Dorset Waste Partnership (19 008 745)

Statement Closed after initial enquiries Refuse and recycling 25-Oct-2019

Summary: The Ombudsman will not investigate Mr and Mrs B’s complaint about the way the authority investigated Mr B’s use of a sole vehicle permit and the authority’s use of surveillance. Further consideration of the complaint would not achieve any more for Mr and Mrs B.

  • Trafford Council (19 008 634)

Statement Closed after initial enquiries Refuse and recycling 22-Oct-2019

Summary: The Ombudsman will not investigate Mr X’s complaint that his neighbour is wrongly being allowed to use two general waste bins. This is because the injustice caused to Mr X from this is not at a level that would warrant our involvement.

  • London Borough of Harrow (19 008 396)

Statement Closed after initial enquiries Refuse and recycling 21-Oct-2019

Summary: The Ombudsman will not investigate this complaint that the Council has failed to remove fly-tipped waste from near the complainant’s home. Although the Council raised the complainant’s expectations and delayed in responding, the resultant injustice is not significant enough to justify the Ombudsman’s continued involvement.

  • London Borough of Merton (18 018 884)

Statement Upheld Refuse and recycling 18-Oct-2019

Summary: the Council delayed responding to queries about how new waste collection arrangements would work and failed to action the change to communal collections properly. That led to Mr B going to time and trouble to pursue his complaint and residents being confused about the dates for their waste collections. An apology and rectification of problems with the online missed collections system is satisfactory remedy for the injustice caused.

  • Medway Council (19 007 965)

Statement Closed after initial enquiries Refuse and recycling 17-Oct-2019

Summary: The Ombudsman will not investigate this complaint about an accident at the recycling centre. This is because there is insufficient evidence of fault by the Council and because there are other organisations better placed to consider the complaint.
