    Summary: Mr X complained the Council failed to make assisted refuse collections from his house. We find the Council has failed to make collections several times, despite his reports and its reminders to crews. The Council has agreed to apologise and refund Mr X’s garden waste collection fee for the year. It will also remind collection crews of the importance of complying with assisted collections and monitor Mr X’s waste collection for three months, reporting to him and the Ombudsman on this.

    Summary: Miss X complains the Council has repeatedly failed to collect her household waste and recycling on the scheduled day or in a timely manner when they are missed. Miss X also complains that although she receives assisted collections, when her bins are collected, they are not returned to the storage point. The Council’s repeated failure to make regular assisted household waste and recycling collections amounts to fault. As does the Council’s failure to properly address Miss X’s complaints or resolve the problem. These faults have caused Miss X an injustice.

    Summary: Mrs X complained the Council incorrectly dealt with an incident when one of its Contractor’s refuse vehicles damaged her car. The Council has already admitted there was fault because Mrs X’s request for footage from the refuse vehicle was not dealt with in a timely manner, meaning the footage was deleted. The Council has offered Mrs X £25 which is sufficient to remedy the time and trouble this caused her. I will not consider any further injustice concerning Mrs X’s claim that her insurance premiums have increased as a result of the incident. This is because such matters concern claims about legal liability and these can only be determined by insurers or the courts.

    Summary: The Ombudsman will not investigate Mr B’s complaint about the Council’s response to his complaint about the Council’s contractors. This is because it is unlikely we would achieve more for Mr B by investigating his complaint about the vehicle driver’s manoeuvre and Mr B has not suffered significant enough injustice from the remaining part of his complaint to justify our involvement.

The Ombudsman finds that, the Council’s failure to consistently collect Mrs C’s household waste and recycling amounts to fault. There was also fault in the way the Council handled Mrs C’s complaint. These faults caused Mrs C an injustice.
