The Council also did not write to Ms B to explain how it decided to reduce Ms B’s care package by 13 hours and gave conflicting information about what she could use the direct payments for. The Council has agreed to apologise to Ms B, repay her for the missed provision, pay her £300, write to Ms B to explain the reduction in the care plan and review the assessment and care plan.

    Summary: Ms B complains about the lack of assistance she has received from the Council’s Adult Social Care Service. The Ombudsman will not investigate the complaint because the Council is taking appropriate action to assist Ms B and an investigation by the Ombudsman is unlikely to lead to a different outcome.

    Summary: The Ombudsman will not investigate Mrs X’s complaint about the Council’s consideration of the value of her father Mr Y’s property. There is not enough evidence of Council fault in the actions it has taken so far, or evidence of injustice caused to warrant investigation. The Council has not yet instructed an independent valuer to complete the valuation. Once that has been done, if Mrs X and her representatives disagree with the outcome and the way the valuation has been done, they may complain to the Council then the Ombudsman if they remain dissatisfied.

    Summary: Ms X complained about restrictions placed on her father in his care home, which include restrictions on contact he has with Ms X. We cannot investigate this complaint. This is because it relates to decisions that have been made by the courts and we have no power to interfere in court decisions.

    Summary: Mr X complained the Council failed to provide him with sufficient information to enable him to make an informed decision about whether to accept a care package. Mr X said that as a result, he was left with a large debt which caused him stress and anxiety. There was no fault in the Council’s actions.

    Summary: Mr P complains the Council has failed to fulfil the remedy on his previous complaint properly, having done so in a way which financially disadvantages him. The Council accepts its July 2019 decision to backdate his financial contribution for residential care to 31 July 2017 will have prevented him from managing his expenses within his personal expenses allowance. It has offered to pay Mr P a further £20,410. This will remedy the injustice it has caused.

    Summary: The Ombudsmen found fault by the Council and Trust with regards to the care and support they provided to a woman with ongoing health needs following her discharge from hospital. The Council and Trust will apologise to the woman’s daughter and pay a financial remedy in recognition of the impact of these events on her.
