Even if the Authority had treated his emails as such a request, there is not enough evidence the Authority would have given permission for its removal. The Authority has apologised for its delayed responses to some emails, and there is no further worthwhile outcome our investigating would achieve.

We have not investigated this complaint because there is no evidence of fault in the Council’s decision to allow work to take place on the tree. We are also unable to carry out a fair investigation into how the Council granted planning permission for a new house next to the tree in 2005. Other parts of the complaint are late and some are matters which Mrs X could raise with the Information Commissioner.
