    Summary: Mrs X complained about the Council’s decision to withdraw an offer of home to school transport when she accepted a place for her daughter at a school further away than the school where it first offered her a place. Mrs X then took up the place at the first school and the Council reinstated the transport offer. We have discontinued our investigation as it would not achieve any useful outcome for Mrs X and her daughter.

The Council says it and the school transport appeal panel considered the appeal properly but could not grant free school transport under its policy. We found the Council and its appeal panel acted without fault.

The Council is at fault as it has not properly considered the impact of her son’s special educational needs on his ability to walk safely to school. This is fault by the Council which has caused injustice. The Council has agreed to reconsider the case.

The Council says it applied its home to school transport policy properly and did not offer an appeal because the appeal arrived after its deadline. We find the Council acted with fault and recommend a remedy.

    Summary: Ms X complained that the Council agreed to help with home to school transport costs for her daughter but delayed in doing so and failed to respond to her emails. She said it also failed to fully respond to her complaint and put in place reasonable adjustments in view of her autism. Ms X suffered distress and inconvenience because of the Council’s failings. Her daughter also suffered distress and was unable to attend her autistic school. The Council has agreed to apologise to Ms X and make a payment in recognition of the injustice caused.

    Summary: Miss B complains that; the Council unreasonably refused to provide home to school transport for her son C to his previous school and the special academy for pupils with moderate learning difficulties named in his Education Health and Care Plan (EHCP); the Council failed to take proper account of the difficulty C has walking long distances due to his hypermobility, or his diagnoses of autism, attention deficit hyperactivity disorder (ADHD) and oppositional defiant disorder (ODD) which make it difficult for him to use regular public transport; as a result, in order to get C to and from school, she has had to pay £400 a month to take C in a private taxi; this put her into debt on her utility bills and she was no longer able to afford the cost of a taxi for C; and  this in turn has severely affected his school attendance and his social and educational development.
