    Summary: We will not investigate Ms X’s complaint about the Council’s decision that the setting up of a family trust amounted to a deprivation of assets. The Council has agreed to make a payment to recognise the uncertainty caused by its delay in making the decision. There is insufficient evidence of fault to justify us investigating the decision-making process.

    Statement Upheld Special educational needs 21-May-2024

    Summary: we uphold Ms M’s complaint that the Council failed to arrange alternative provision for B for one term in summer 2022 and took too long to amend his EHC Plan following the March 2022 annual review meeting. However, the Council’s offer of £2,000 is an appropriate remedy for the injustice caused.

    Statement Upheld Special educational needs 28-Aug-2024

    Summary: Mr X complained about the way the Council dealt with Z’s Education, Health and Care Plan and education and special educational needs provision. We have found fault by the Council in: failing to make alternative provision for Z from January to March 2023; deliver Z’s SEN provision from January to July 2023; and complete the EHC Plan review process within the statutory timescales. This fault caused injustice. The Council has agreed to remedy this by: apologising; making payments to reflect the distress and worry caused and the impact on Z of the missed provision; issuing the final amended EHC Plan; and making a service improvement.

    Statement Upheld Safeguarding 29-Aug-2024

    Summary: Mr X complains the Council did not properly gather and consider information during a safeguarding enquiry, and the Council concealed and obstructed his attempts to provide further evidence. The Ombudsman finds fault with the Council for how it managed communication with Mr X. However, the Council has already recognised and remedied this in its complaint response, and therefore no further remedy is warranted.

    Statement Upheld Refuse and recycling 10-Jan-2025

    Summary: Mr X complained the Council repeatedly failed to collect his garden waste in 2023, and failed to respond to his escalated complaint. The Council was not at fault over missed garden waste collections. However, the Council was at fault for failing to properly consider Mr X’s complaint. This caused Mr X some frustration and inconvenience which the Council agreed to apologise for.
