Statement Upheld School transport 19-Apr-2023
Summary: Mrs X complained about how the Council dealt with her request for additional education travel support for her child who was temporarily confined to a wheelchair after a planned surgery. There was fault by the Council in how it dealt with Mrs X’s case and its poor communication with her. This has caused injustice to Y and Mrs X. The Council will take action to remedy the injustice caused.

Statement Upheld Traffic management 08-May-2023
Summary: Mr X complained the Council had not complied with the disability elements of the statutory guidance for the Traffic Management Act when it introduced an Experimental Traffic Regulation Order. We found fault with the Council for failing to liaise and consult with local disability groups when designing its Experimental Traffic Regulation Order. We also found fault with the Council for failing to consider completing an equality assessment and for poor record keeping. The Council agreed to provide a public apology to local disability groups and provide guidance and training to its staff.

Summary: We have upheld this complaint because the Council delayed considering a complaint at stage three of the children’s statutory complaints procedure. The Council has now agreed to resolve the complaint by apologising to the complainant and offering to make a payment to them to remedy the time and trouble they have been too. It will also arrange a stage three panel to take place within one month.

Statement Upheld Parking and other penalties 20-Jul-2023
Summary: The Council was at fault for how it consulted residents before introducing a new controlled parking zone in the area around Mr B’s home. This is because its approach was at odds with the language in its policy. Despite this, the Council’s decision to proceed with the parking scheme was reasonable in the circumstances, and therefore Mr B suffered no injustice. Nonetheless, the Council has agreed to review its policy to prevent similar problems in future.

Summary: Mrs X complains the Council did not properly deal with charges for her husband’s care. The Council agrees it is at fault because care charges were not properly explained to Mrs X and it calculated care charges incorrectly. Mrs X was incorrectly charged. The Council has agreed to refund all the relevant charges. This is an appropriate remedy.

Summary: We found fault by the Council, Hospital Trust and Community Trust with regards to the information they provided to Mr X and Mrs Y regarding available care and support services in the area. We also found fault by these organisations concerning their handling of Mr X’s complaint. They will apologise to Mr X and Mrs Y and take action to ensure appropriate information is available to people as part of the hospital discharge process.

Summary: There is evidence of fault in the way a Care Provider, acting on behalf of the Council, communicated with Ms X at the end of, and immediately after, her mother’s death. The Care Provider’s response to Ms X’s complaint lacked transparency and sensitivity.

Statement Upheld Alternative provision 12-Oct-2023
Summary: The complainant (Miss X) said the Council failed to safeguard her son (Y), to comply with the statutory timescales for Education Health and Care (EHC) plan reviews, to provide Y with suitable alternative education, to arrange transport for Y to his new school from the beginning of the autumn term 2022 and to communicate adequately with Miss X and Y’s school. We found fault with the Council in most of the issues raised by Miss X. Some of these faults caused Y and Miss X injustice. We did not find fault with the Council’s safeguarding. The Council agreed to apologise and make symbolic payments to remedy the injustice caused to Y and Miss X.
