    Statement Upheld Alternative provision 04-Apr-2024

    Summary: Ms X complained the Council failed to provide suitable alternative provision of education for her child since April 2023. We found fault with the Council for delays in production of Ms X’s child’s Education and Health Care Plan and for failing to provide suitable education. The Council offered to pay Ms X £6,000 for the missed education and £250 for the avoidable time and trouble Ms X experienced. We are satisfied this offer suitability reflects the fault in this matter and have ended our investigation because the Council agreed a suitable remedy.

    Statement Upheld Special educational needs 21-Apr-2024

    Summary: Mrs X complained the Council failed to provide education for her child from May 2021 until May 2023. We found fault with the Council for delaying production of Mrs X’s child’s Education and Health Care plan for 21 months and failing to keep Mrs X suitably informed. We also found fault with the Council failing to provide suitable education for Mrs X’s child from May 2021 to September 2022. The Council agreed to apologise to Mrs X and pay her £4,850 in recognition of her child’s lost education and £750 for the prolonged distress and uncertainty caused by the Council’s fault.

    Summary: The Council was not at fault for its delivery of Ms B’s daughter’s special educational needs support, or for its handling of
    Ms B’s complaints. However, it was at fault for delays to its assessments of Ms B’s daughter’s needs. It has agreed to apologise to Ms B, make a small, symbolic payment to recognise her daughter’s injustice, and set out ways in which it will improve its service.

    Statement Upheld Special educational needs 06-May-2024

    Summary: Miss B complained about the Council’s failure to issue an Education, Health and Care Plan for her son within legal timeframes and he had been left without education for several months. We found the Council at fault for significant delays in the needs assessment process and for not properly considering its duties to arrange alternative provision. The Council has agreed to our recommendations to remedy the injustice caused.

    Statement Upheld Special educational needs 07-May-2024

    Summary: The Council failed to carry out an Education, Health and Care Needs assessment for Miss H’s son, J, within the statutory timeframes. This was due to a shortage of educational psychologists. We are satisfied with the Council’s action plan to increase its access to educational psychologists. However, to recognise the personal injustice caused to Miss H and J, the Council will make payments for the delay.

    Summary: Mr X complains the Council did not deal properly with an appeal about a Penalty Charge Notice (PCN). The Council is at fault because it did not properly consider Mr X’s disability in relation to how he could appeal the PCN. The Council should apologise and review its policy and processes.

    Statement Upheld Homelessness 13-May-2024

    Summary: Miss F complained about the way the Council dealt with her homelessness application. The Council has accepted it gave her incorrect advice in May 2023. The Council also failed to issue a homelessness decision letter in October 2022. These faults have caused Miss F distress and uncertainty and to lose appeal rights but I do not find they caused her to miss out on accommodation. There was also fault in complaint handling, causing her time and trouble. The Council has agreed to make a payment to Miss F to remedy the injustice caused.

    Statement Upheld Assessment and care plan 27-May-2024

    Summary: Mr D complained about the Council’s handling of his Care Act needs assessment and how it communicated with him. He said, as a result, he experienced distress and a loss of support. We found the Council at fault for causing delays to properly assess Mr D’s needs over a 10-month period. We did not find fault in how it had regard to his reasonable adjustment request for how it communicated with him. The Council will apologise and make payment to acknowledge the distress and loss of support Mr D experienced.

    Statement Upheld Refuse and recycling 29-May-2024

    Summary: Miss X says the Council has repeatedly failed to collect or replace her bin in line with the assisted collection she has agreed. Miss X says this has caused her distress and she has had to pay to remove waste resulting from the missed collections. We have found fault in the actions of the Council for the missed collections. We recommend a payment to recognise the distress caused and for the Council to take steps to ensure collections are completed.

    Statement Upheld Council tax 05-Jun-2024

    Summary: Mr X complained about how the Council dealt with his council tax bills and the enforcement action it took to recover the amounts owed. There was fault by the Council for its poor record keeping. This caused distress and frustration to Mr X. The Council will take action to remedy the injustice caused.
