Summary: Mr A complained the Council caused delays in implementing his care package. The Council agreed it caused a delay. We found the Council at fault, but it has offered an appropriate remedy. We have not therefore recommended that any further remedy is due.

Summary: X complained about the costs caused by incorrect advice given by a planning officer. The Council has already admitted fault and made an offer to compensate X for some of their costs. We found fault, but it was not necessary to make any further recommendations beyond the remedy already offered by the Council. This was because the Council should not be held solely responsible for what had happened.

Summary: We will not investigate this complaint about the Council’s knowledge on the Nearest Relative under the Mental Health Act, and how it treated the Nearest Relative when their relative was in mental health crisis. The Council has apologised to the complainant for the distress it caused and has committed to training relevant staff. We are satisfied with the Council’s actions; it is unlikely an Ombudsman investigation would reach a different outcome.

Summary: Mrs B complains about the Council’s delays in carrying out an Education, Health and Care needs assessment for her daughter and issuing the final Education, Health and Care Plan (EHC Plan). There was fault by the Council. It did not meet statutory timescales during the EHC Plan process. Because of this, Mrs B suffered distress and she spent time and trouble chasing the Council for updates. The Council’s failure to meet statutory timescales also delayed her appeal right to the Tribunal. The Council will make a symbolic payment to Mrs B, apologise to Mrs B and her daughter and issue a staff briefing.

Summary: Mr X complained the Council had started to charge him for transport services although he believed he was eligible for s117 aftercare and should not pay charges. The Council has provided evidence he was not eligible for free aftercare. Following an investigation into Mr X’s complaint about the unreliability of the transport service, and his decision to arrange alternative provision, the Council has now waived all charges. The complaint will not be investigated further as there is no outstanding injustice.
