When we find fault, we can recommend improvements to systems and processes where they haven’t worked properly, so that others do not suffer from these same problems in future. Common examples are policy changes; procedural reviews; and staff training. Service improvements from decisions are published for 5 years and those from reports are published for 10 years.

    Summary

    Mr X complained about charges for his father, Mr Y’s, care. He also complained the Council delayed the assessment process and failed to update him with the outcome of its safeguarding investigation. We found fault with the Council. The Council agreed actions to remedy the injustice to Mr X and Mr Y.

    The Council agrees to review its section 42 safeguarding procedure to ensure it includes: • The format for ‘others’ to provide the information from enquiries. • How the Council retains oversight and responsibility for the enquiries that it asks ‘others’ to conduct. • How the Council reviews the information from ‘others’ and records its consideration and decision making. • How it communicates the outcome with the adult (and/or their representative)
