When we find fault, we can recommend improvements to systems and processes where they haven’t worked properly, so that others do not suffer from these same problems in future. Common examples are policy changes; procedural reviews; and staff training. Service improvements from decisions are published for 5 years and those from reports are published for 10 years.

    Summary

    The Council failed to properly consider the impact on Mrs B’s privacy when it granted planning permission for a development next to her home. It also delayed in investigating her complaint about the external lighting of the building. The Council has agreed my recommendations to remedy Mrs B’s complaint.

    Summary

    Miss Y complains about the Council’s failure to safeguard her children when they were placed into short-term foster care under an Interim Care Order. We find some fault by the Council causing injustice to Miss Y and her daughter, D. The Council will pay £500 to Miss Y and undertake the service improvements listed at the end of this statement.

    The Council will arrange a briefing note or staff training for the relevant social workers to remind them of the requirements around the administration, storage and transportation of prescribed medication for children in local authority care.The Council will also remind officers who deal with complaints of the requirement to signpost to the LGSCO once the Council has completed its complaint investigation.

    Summary

    Mr X complained about charges for his father, Mr Y’s, care. He also complained the Council delayed the assessment process and failed to update him with the outcome of its safeguarding investigation. We found fault with the Council. The Council agreed actions to remedy the injustice to Mr X and Mr Y.

    The Council agrees to review its section 42 safeguarding procedure to ensure it includes: • The format for ‘others’ to provide the information from enquiries. • How the Council retains oversight and responsibility for the enquiries that it asks ‘others’ to conduct. • How the Council reviews the information from ‘others’ and records its consideration and decision making. • How it communicates the outcome with the adult (and/or their representative)

    Summary

    Miss B complained the Council delayed finalising her son’s education, health, and care plan and failed to secure alternative educational provision when he was out of school. She also complained the Council threatened to take her to court because her son was not attending school. She said this put a strain on the family and caused distress. The Council failed to secure education and education, health and care provision for Miss B’s son. The Council has agreed to apologise to Miss B and her son and make a financial payment to remedy the injustice caused by its faults.

    Remind relevant staff of the Council’s duty under Section 19 of the Education Act 1996 to provide alternative education when a child is absent from school regardless of whether the child remains on roll at a school.Remind relevant staff of the Council’s duty to issue an amended final EHC plan within 14 weeks of the request for a reassessment.Review when it considers it appropriate to issue a school attendance warning notice in cases where the child’s EHC needs are being reassessed.
