Statement Upheld Domiciliary care 20-Apr-2021
Summary: We found fault with the support a Trust provided to a man with complex care needs and his parents. We also found fault by a Council in terms of the handling of the Mental Health Act Assessment process by an Approved Mental Health Practitioner acting on its behalf. The Council and Trust will apologise to the complainants and pay a financial sum in recognition of the distress caused to them by this fault. They will also take action to prevent similar problems occurring in future.

Statement Upheld Special educational needs 11-May-2021
Summary: Mr and Mrs B complained about the Council updating their daughter’s EHCP following a decision by the tribunal and delay in making the provision. There was fault by the Council which caused injustice to Mr and Mrs B and their daughter. The Council will remedy this by apologising and making a payment.

Statement Upheld Special educational needs 24-Nov-2021
Summary: Mrs X complained about the Council’s actions to support the educational needs of her son Y from September 2018. We find the Council was at fault for a delay in issuing Y’s Education Health and Care plan and for failing to consider whether he needed alternative provision when he stopped attending school because of anxiety. That caused Mrs X avoidable distress and meant Y went a short period without suitable education. The Council has agreed to apologise to Mrs X and make a payment to remedy any injustice caused.
