  • Cheshire East Council (21 016 753)

Statement Closed after initial enquiries Covid-19 16-Mar-2022

Summary: We will not investigate this complaint about the Council’s lack of enforcement relating to hours of operation at a construction site. There is not enough evidence of fault to justify investigating part of the complaint, and no evidence of injustice caused to Mr X by the other part.

  • Barnsley Metropolitan Borough Council (21 006 397)

    Statement Upheld Covid-19 27-Jan-2022

Summary: A technical problem in the broadcast of a planning committee meeting was service failure by the Council. However, this problem did not affect the outcome of the meeting, and so there is no injustice to the complainant. It is not fault for the Council’s Chief Executive to not personally reply to correspondence. We have therefore completed our investigation.

  • Salford City Council (21 012 498)

Statement Closed after initial enquiries Covid-19 11-Jan-2022

Summary: We will not investigate this complaint about the Council’s failure to take enforcement action over Mr X’s claims of breaches in planning conditions applied to a nearby supermarket site. There is insufficient evidence of fault which would warrant an investigation.

  • Peterborough City Council (21 006 829)

Statement Closed after initial enquiries Covid-19 18-Oct-2021

Summary: We will not investigate this complaint about the Council’s decision to approve three planning applications during lockdown. The complaints about the first two applications are late and we have seen no reason to exercise discretion. And we have not seen evidence of fault in the process the Council followed leading to its approval of the third application.

  • East Riding of Yorkshire Council (21 005 929)

Statement Closed after initial enquiries Covid-19 10-Sep-2021

Summary: We will not investigate Mr X’s complaint about the Council’s determination of his planning application. This is because it would be reasonable for Mr X to appeal to the Planning Inspectorate.

  • Tandridge District Council (20 008 955)

    Statement Not upheld Covid-19 23-Aug-2021

Summary: Mr X complained about the Council’s decision to grant planning permission for his neighbour to build a two-storey extension to the side of their house. The Ombudsman found no fault in the way the Council considered Mr X’s neighbours’ planning application.

  • Mid Devon District Council (20 007 583)

    Statement Upheld Covid-19 02-Aug-2021

Summary: Mrs X complained about the way the Council consulted on planned local development during the COVID-19 pandemic. She said the Council excluded some older residents, and those who cannot access the Internet. The Ombudsman found the Council was not at fault in the way it carried out consultation. It was at fault for a delay responding to Mrs X’s complaint, but its apology is sufficient remedy.

  • South Ribble Borough Council (20 013 171)

    Statement Not upheld Covid-19 29-Jul-2021

Summary: Mr X complained about the way the Council considered a planning application for a development near his home during the COVID-19 pandemic. There was no fault in the decision making process.

  • Torbay Council (21 000 654)

Statement Closed after initial enquiries Covid-19 10-Jun-2021

Summary: We will not investigate this complaint about the Council’s decision to approve a planning application without visiting the objector’s homes. We have not seen evidence of fault in the way the Council considered the application. Without evidence of procedural fault, we cannot consider the merits of the decision.

  • Manchester City Council (20 014 460)

Statement Closed after initial enquiries Covid-19 25-May-2021

Summary: The complainant says the Council failed to tell him about his neighbour’s planning application. And failed to consider the impact on his privacy when it granted planning permission. We will not investigate this complaint. We have not seen evidence of fault in the way the Council made its decision.
