Birmingham City Council (24 015 016)
Statement Upheld Refuse and recycling 02-Jun-2025
Summary: Miss X complained the Council has repeatedly failed to empty the communal waste bins that service her block of flats as scheduled. This led to an accumulation of waste which makes the area looks untidy, causes unpleasant smells, and attracts rodents. We found the Council’s repeated failure to collect the communal waste is fault. The Council has agreed to apologise and make a payment to Miss X.
-
South Tyneside Metropolitan Borough Council (24 020 187)
Statement Closed after initial enquiries Refuse and recycling 02-Jun-2025
Summary: We will not investigate Mr X’s complaint about the Council’s decision to charge him for a replacement bin because the claimed injustice is not significant enough. We will not investigate Mr X’s complaints about staff conduct, the Council’s complaints process, or the Council’s implementation of his request for reasonable adjustments because there is insufficient evidence of fault for most of these matters, and an investigation is unlikely to achieve a different outcome for the remainder.
-

The Council apologised, offered a refund, and a symbolic payment to Miss X. It acknowledged a procedural error in its payment processing and said it would send the refund within four weeks. An investigation is unlikely to achieve anything further.

London Borough of Croydon (24 012 078)
Statement Upheld Refuse and recycling 21-May-2025
Summary: Mrs X complained the Council provided an inadequate refuse service for her clinical waste. The Council was at fault for poor record keeping, failing to investigate Mrs X’s concerns appropriately and for providing inaccurate information about changes to its service. This caused Mrs X avoidable frustration and uncertainty for which the Council will apologise and pay £150. It will also update the information available to residents on what waste can go in general waste bins.

-
Birmingham City Council (25 001 213)
Statement Closed after initial enquiries Refuse and recycling 19-May-2025
Summary: We cannot investigate Mr X’s complaint that the Council failed to collect his household waste. This is because the matter relates to industrial strike action which affects all or most of the Council’s residents, and the law says we cannot investigate.
-
Welwyn Hatfield Borough Council (24 022 325)
Statement Closed after initial enquiries Refuse and recycling 14-May-2025
Summary: We will not investigate Mrs X’s complaint about the Council issuing her a Fixed Penalty Notice for alleged fly tipping. This is because Mrs X had the opportunity to raise a defence against the issuing of the notice in court rather than paying it.
