The complaint

Mr C complains about a number of aspects of the way the school's appeal panel considered his appeal, and recorded their notes of the hearing.

Finding

The Ombudsman upheld the complaint and found fault causing injustice.

Recommendations

To remedy the injustice caused, we recommend the school:

  • arrange a fresh appeal for Mr C with a new panel and clerk within six weeks of the date of this report;
  • offer to hold fresh appeals for others who have not had their appeal upheld in this academic year and to make the arrangements within two months of the date of this report; and
  • ensure that clerks and panels are properly trained and understand their legal role including their functions as set out in the School Admissions Appeals Code (2012) within three months of the date of this report and to report back to us when this has been done.
