Summary: Mrs X complained about how the Council handled an annual review of her child’s (Y) Education, Health and Care Plan. Mrs X also complained the Council poorly communicated with her and it failed to provide Y with suitable education when he finished his placement at his previous college. There were faults by the Council which caused injustice to Y and Mrs X. The Council will take action to remedy the injustice caused.

X said that, because of this, they incurred greater costs which the Council should pay. We found no fault in the way the Council has acted.

Statement Upheld Alternative provision 01-Jul-2025
Summary: Ms X complained the Council failed to provide alternative provision for her son when his educational placement broke down. She is also concerned about the Educational Psychologist report, the Councils requests for medical evidence and its failure to consider her complaint at stage two. The Council is at fault for failing to offer a stage two investigation. This has caused Ms X distress for which I have recommended a remedy.

Summary: Mrs X complained the Council did not manage the transition from children’s services to adult social care for her daughter, Ms G, failed to meet Ms G’s identified needs when she finished education, and failed to communicate with Mrs X about the matter properly. The Council was at fault when it made errors in deciding how Ms G’s care needs could be met, and in communicating those decisions to Mrs X. The Council will apologise and make symbolic payment to Ms G for the care she did not receive and to Mrs X for the avoidable distress and impact on her own health conditions caused by the Council’s faults.

Summary: We found fault by the Council on Miss Z’s complaint about it failing to transfer her to alternative accommodation after deciding it was unsuitable in March 2023. The Council failed to move her from the property, show a record of its decision about unsuitability at the time it made it, send her a copy of the decision, or act to address the causes of its concerns while she remained in it. These failures caused avoidable injustice. She remained in an unsuitable property which did not meet their needs. The Council agreed to send her a written apology, pay £4,050 for the time she spent in unsuitable accommodation, pay £150 a month until she is moved, find her alternative accommodation, review what happened, and remind officers of the need to tell tenants about decisions when made.
