St Helens Metropolitan Borough Council (24 014 815)
Statement Not upheld Other 21-Apr-2025
Summary: Miss J complained the Council has lost the deeds to her late father’s house, making it difficult to sell and possibly reducing its value. We have decided to discontinue this investigation. This is because we cannot practically investigate the loss of the deeds, and claims for significant financial loss should be made to the courts.
-

Bath and North East Somerset Council (24 001 607)
Statement Upheld Assessment and care plan 21-Apr-2025
Summary: Mrs X complains the Council has failed to assess her sister’s needs properly and has failed to get the deprivation of her sister’s liberty authorised. The Council has delayed in reviewing her sister’s needs and in applying to have the deprivation of her liberty authorised. It also failed to ensure she received a consolidated response to all her concerns. The Council needs to apologise to Mrs X for the distress it has caused. It also needs to apply to the Court of Protection to have the deprivation of her sister’s liberty authorised and take action to improve its services.

City of Bradford Metropolitan District Council (24 007 332)
Statement Upheld Special educational needs 21-Apr-2025
Summary: Ms X complained that the Council failed to provide full-time education and special educational provision for her son (Y). She also complained about the Council’s delay in reviewing Y’s Education Health and Care Plan, its failure to re-assess Y’s speech and language needs and to communicate with her. We found fault with the Council. This fault caused injustice to Y and Ms X. The Council has agreed to apologise and make payments to recognise Y’s loss of provision and Ms X’s distress. The Council has also agreed to reimburse Ms X for the cost of a Speech and Language Therapy report.
-
Gloucestershire County Council (24 007 719)
Statement Upheld Assessment and care plan 21-Apr-2025
Summary: Mrs X complained the Council has not made reasonable allowances for Disability Related Expenses for her son. We found fault with the Council’s rationale of declining a Disability Related Expense for Cetaphil. We did not find fault with the Council’s other decisions but are aware new evidence is now available to Mrs X. The Council agreed to reconsider its decision about declining a Disability Related Expense for Cetaphil. The Council also agreed to write to Mrs X to detail what evidence it needs so it can reconsider other Disability Related Expense requests.

Statement Closed after initial enquiries Homelessness 21-Apr-2025

-
Leeds City Council (24 018 444)
Statement Closed after initial enquiries Special educational needs 21-Apr-2025
Summary: We cannot investigate Miss X’s complaint about how the Council handled her child’s Education, Health and Care Plan. Part of the complaint is late, and there are no good reasons why we should consider it. Additionally, we cannot consider any matter connected to a decision that has been appealed to a tribunal. For the part of Miss X’s complaint we can investigate, the Council have already made an offer of a symbolic remedy, and it is unlikely we would achieve any further outcome.
