We found fault with Azure Charitable Foundation for failing to share its complaint process and a copy of Mr Z’s contract or service user guide with Miss X, Mr Z’s relative. This did not cause a significant personal injustice to either Miss X or Mr Z.

Summary: Mrs X complained West Sussex County Council failed to provide her late husband, Mr X, with alternative domiciliary care after a care agency ended its contract. She said this meant he had to go into residential care in one of Saffronland Homes’ nursing homes. Mrs X says he received poor care there from both the nursing home and Maywood Health Centre. Mrs X says Mr X was unhappy in the care home and considers he would still be alive, had he received better care. We will not investigate this complaint. Parts of the complaint are late. For other parts, it would have been reasonable for Mrs X to seek a legal remedy in the courts. We are unlikely to achieve the outcome Mrs X seeks by investigating the rest of her complaint.

Summary: Mrs X complained the Council failed to ensure her mother, Mrs Y, had suitable care at home. The Council was at fault. It was also at fault in how it decided that it would not take action to safeguard Mrs Y’s welfare. The faults caused Mrs X significant distress and uncertainty, for which the Council will apologise and pay her £300. It will also issue a staff reminder to prevent similar fault in future.

Summary: Mr Y complained about how the Care Provider dealt with his late mother’s, Mrs X’s, care fees when she was admitted to hospital and how it handled his complaint. There were some faults by the Care Provider which caused injustice to Mr Y. The Care Provider should take action to remedy the injustice caused.
