Summary: Mr B complains about the Section 117 aftercare his brother, Mr C, received after he was discharged from hospital. The Council, Trust and ICB carried out an assessment of Mr C’s needs for Section 117 aftercare and put in place a support package over the following months. However, there was a delay in a review of the care plan in November 2022 and this was fault. The Council, Trust and ICB have agreed to apologise to the family and to pay a financial remedy.

Summary: Mr X complained about the Council charging him a personal care contribution and complaint handling delays. The Council did not incorrectly charge Mr X for personal care or fail to complete a financial assessment review. However, we find it failed to respond to Mr X’s request for a Care and Support plan review and delayed its response to his complaints. The Council will apologise to Mr X and pay him £200 in recognition of uncertainty, frustration and inconvenience caused. It should also make a decision about Mr X’s Care and Support plan review request and advise him of the outcome.

Summary: Mrs X complained that the Council failed to provide all the provision set out in her daughter’s Education, Health and Care plan. Mrs X said this meant her daughter missed out on provision she was entitled to, and it caused Mrs X unnecessary distress and frustration. We find there was a service failure which caused Mrs X and her daughter injustice. The Council will apologise and make a payment to Mrs X to reflect the injustice caused.
