Summary: Ms D complained the Council sent her a bill for her late grandfather’s (Mr X) care, eight months after he died and after his estate was distributed. Based on current evidence, the Council is at fault for poor communication which caused a delay in it being notified of Mr X’s death. This caused Ms D emotional distress and will potentially cause her financial distress. I have recommended the Council asks Ms D for information about the debt and estate so it can reconsider the amount. I have also recommended the Council offers Ms D a payment plan for any remaining debt.

Summary: Mr X complained about how the Council supported his child, Y’s, special educational needs. There was fault in how the Council failed to act when it became aware some of Y’s support was not being provided and in significant delays responding to Mr X’s complaint. Summary: Miss X complained about the Council’s delay issuing her child, Y’s amended final Education, Health and Care Plan, failed to provide suitable alternative provision while Y was out of school, communicated poorly and delayed responding to her complaint. We find the Council at fault, causing Miss X avoidable distress and uncertainty. The Council has agreed to apologise, make a payment to Miss X, and issue Y’s amended final EHC Plan.

Summary: Ms X complains the Council failed to deal properly with the charges for her father’s care, including failing to take account of the fact he had dementia and his family could not access his money until after he died. The Council failed to deal properly with the charges for her father’s care. This resulted in it charging his estate legal costs and interest, despite having no policies for doing so. It also put Ms X to significant time and trouble in pursing the complaint. The Council needs to apologise and refund money to her father’s estate. It also needs to improve its working practices.

Summary: Miss X complained the Council placed her and her child in unsuitable temporary accommodation. She stated it took too long to complete a review of the suitability of her accommodation and placed her housing register application in the wrong priority band. We found fault by the Council on both matters. This meant Miss X has lived in unsuitable accommodation for over two years. To remedy her injustice the Council agreed to apologise, pay her £3750 and make a monthly payment for every month she remains in unsuitable accommodation.

There was fault in the way the Council delayed completing the needs assessment. This frustrated Miss X and frustrated her right of appeal to the Tribunal. The Council has agreed to apologise, make a financial payment and provide guidance to its staff.
