    Summary: Mrs X complained the NHS Trust and the Council discharged her father from hospital into an unsuitable care home. We found fault by the NHS Trust, but we could not say this would have led to a different outcome. The NHS Trust has already accepted the fault, but we recommended it apologises to Mrs X for the uncertainty caused. We did not find fault by the Council’s actions, but we did find fault with how it dealt with Mrs X’s complaint. We made recommendations to address this.

She also complained about poor communication by the organisations. We have upheld the complaint and found the faults caused significant injustice to Miss D and Mrs M. This includes Miss D missing all her education and essential special educational needs support for about 12 months. Mrs M could not take her usual breaks from her caring role, leaving her exhausted. The organisations’ faults also caused Mrs M avoidable distress and time and trouble. The organisations accepted our recommendations, so we have completed our investigation.

    Statement Upheld Alternative provision 01-Jul-2025

    Summary: Ms X complained the Council failed to provide alternative provision for her son when his educational placement broke down. She is also concerned about the Educational Psychologist report, the Councils requests for medical evidence and its failure to consider her complaint at stage two. The Council is at fault for failing to offer a stage two investigation. This has caused Ms X distress for which I have recommended a remedy.

    Statement Upheld Transport 01-Jul-2025

    Summary: Mrs X complained the Council did not manage the transition from children’s services to adult social care for her daughter, Ms G, failed to meet Ms G’s identified needs when she finished education, and failed to communicate with Mrs X about the matter properly. The Council was at fault when it made errors in deciding how Ms G’s care needs could be met, and in communicating those decisions to Mrs X. The Council will apologise and make symbolic payment to Ms G for the care she did not receive and to Mrs X for the avoidable distress and impact on her own health conditions caused by the Council’s faults.
