Summary: Mr and Mrs X complained about the Council’s decision to stop Special Guardianship (SG) Allowance payments in respect of their niece, F. The Council’s decision to stop the payment was in line with its policy. However, the appeal panel’s report is flawed and does not show how the panel considered relevant evidence Mr and Mrs X submitted. The Council agreed to hold a new appeal review with a fresh panel to remedy the uncertainty this has caused. It will also pay Mr and Mrs X £509.81 after it found it had underpaid their SG Allowance during 2019.

The delay has caused frustration and distress and means his complaint remains unresolved. The Council is at fault. It has agreed to hold the stage three panel within 30 working days and pay Mr X £200 in recognition of the frustration and distress caused by the delay. It will also review its procedures.

Summary: Ms Y complains the Council refused to assess both herself and her daughter, D, because it uses criteria which excludes those with Autism and has a confusing system which is difficult to access. There is no fault because the Council did assess Ms Y, and D now receives weekly support. However, the Council failed to respond to Ms Y’s complaint, but it has already apologised which is an appropriate remedy.

Summary: The complainant alleged that the Council wrongly refused her assistance for childcare for her disabled daughter during the school holidays and when the complainant required support during a hospital admission and recovery. We find some fault concerning the request for support when the complainant had to go into hospital but cannot conclude the outcome would have been different. The Council has already accepted fault in the initial assessment process, and we have considered the resulting injustice, and recommended a remedy for this. The Council has accepted this. Therefore, we are closing the complaint.
