  • Kent County Council (23 010 806)

Statement Upheld Special educational needs 08-May-2024

Summary: There was fault by the Council. The Council delayed issuing an amended Education, Health and Care Plan after an annual review. This meant the parents appeal rights were delayed. The Council also did not monitor the progress of a funded reintegration plan into school. An apology, payment and revised procedure remedy the injustice of loss of education.

  • Kent County Council (23 012 748)

Statement Upheld Special educational needs 02-May-2024

Summary: There was continued fault and delay by the Council in completing a statutory reassessment and a failure to secure provision in an Education, Health and Care Plan. There was administrative fault in the way the advice for reassessment was handled. There was also non-compliance with previous Ombudsman agreed recommendations. This caused distress, time, trouble and lost educational provision. The council will apologise, make a financial payment and carry out service improvements.

  • Kent County Council (23 020 661)

Statement Closed after initial enquiries School transport 01-May-2024

Summary: We will not investigate this complaint about the standard of a Council bus service. Though the Council does acknowledge failings, there is insufficient evidence of a significant enough injustice being caused to the complainant to warrant a formal investigation.

  • Kent County Council (23 020 357)

Statement Closed after initial enquiries Special educational needs 01-May-2024

Summary: We will not investigate Ms B’s complaint about the Council’s decision not to issue her child with an education, health and care (EHC) Plan. This is because Ms B has a right of appeal to a tribunal and it would be reasonable for her to use it.

  • Kent County Council (23 020 568)

Statement Closed after initial enquiries Highway repair and maintenance 30-Apr-2024

Summary: We will not investigate this complaint about highway maintenance because there is not enough evidence of fault to justify investigation.

  • Kent County Council (23 006 264)

Statement Upheld Special educational needs 28-Apr-2024

Summary: Ms X complained the Council failed to secure a place for their child at their preferred education placement. We found no fault in the Council not securing the place. But we found fault with its communications about this issue and delay in answering Ms X’s complaint. These faults caused unnecessary distress. The Council has accepted these findings. At the end of this statement, we set out the action it has agreed to remedy this injustice.

  • Kent County Council (23 020 390)

Statement Closed after initial enquiries Transport 28-Apr-2024

Summary: We will not investigate Mr X’s complaint about the Council’s decision that he is not eligible for a blue badge. There is insufficient evidence of fault to warrant an investigation. The Information Commissioner’s Office is better placed to consider a complaint about access to records.

  • Kent County Council (23 019 132)

Statement Closed after initial enquiries Transport 28-Apr-2024

Summary: We will not investigate this complaint about delay in the Council considering and deciding her application for a blue badge. This is because an investigation would not lead to any further findings or outcomes.

  • Kent County Council (23 020 223)

Statement Closed after initial enquiries Other 24-Apr-2024

Summary: We will not investigate Mr X’s complaint about the Council’s failure to agree the reasonable adjustments he requested for a speed awareness course administered by the Council. There is insufficient evidence of fault to warrant an investigation.

  • Kent County Council (23 018 722)

Statement Closed after initial enquiries Residential care 18-Apr-2024

Summary: We will not investigate this complaint about a missing item from a residential care home. This is because it is unlikely we could add to the Council’s investigation which could not identify how and when the item went missing. It would be more suitable for the police or insurance company to consider the complaint about the missing item, as either theft or a claim to replace the lost item.
