Statement Closed after initial enquiries Licensing 25-Mar-2022

Summary: We will not investigate this complaint about the actions of the Council connected to the issuing of a premises licence. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. The complainant had a right of appeal to the Magistrate’s Court.

  • London Borough of Richmond upon Thames (21 017 470)

Statement Closed after initial enquiries Refuse and recycling 25-Mar-2022

Summary: We will not investigate this complaint about how the Council dealt with a report of an overflowing bin. This is because there is not enough evidence of fault in how the Council dealt with the matter. Nor is there evidence that the issue has caused the complainant a significant injustice.

  • London Borough of Enfield (21 006 049)

Statement Upheld Refuse and recycling 24-Mar-2022

Summary: Mr X complained the Council failed to replace a shed that burnt down and failed to clear land adjoining the allotments despite agreeing to do this. The Council misled Mr X for a short period regarding a replacement shed but there is no evidence it had an obligation to replace it. The Council should apologise for misleading Mr X and should also inspect the land to ensure it has been cleared as agreed.

Statement Closed after initial enquiries Trees 24-Mar-2022

  • East Devon District Council (21 007 341)

    Statement Upheld Other 23-Mar-2022

Summary: Mrs X complains the Council has failed to take sufficient action to stop a resident from feeding birds which is causing a nuisance. The Council is at fault as its investigation drifted. This is because it did not consider if the investigation should be carried out by its Environmental Health Team when its Housing Management Team could not progress the investigation. This caused frustration and uncertainty to Mrs X. The Council has agreed to remedy this injustice by apologising to Mrs X and drawing up an action plan to ensure its investigations do not continue to drift.

  • Carlisle City Council (21 017 886)

Statement Closed after initial enquiries Refuse and recycling 23-Mar-2022

Summary: We will not investigate Mr X’s complaint about the Council not providing him with a free garden waste bin, to replace the one missing when he moved into his house. There is not enough evidence of Council fault, and the matter does not cause Mr X a significant personal injustice, to warrant us investigating.
