We also consider Durham County Council’s poor communication with Mr P’s wife, Mrs P, about his care and support leaves her uncertain if Mr P would have received different care and support before he died.

    Summary: The investigation into this complaint is discontinued. The Council acknowledged it failed to review Mr Y’s care needs and failed to inform him his direct payments had ceased. It remedied this situation before the complaint came to this office. There is no fault by the Council in its refusal to reinstate direct payments for services not in place or backdate payments for services not received.

    Summary: There was fault as there was a delay in the Council providing Ms C’s parents with Ms C’s care plan to address the risks/need that it had identified and a delay in providing the mental capacity assessment. The documents were also not fully completed and not always clear. The Council has agreed to apologise, to carry out a review assessment and provide an updated care plan and to pay £300.

    Summary: The Ombudsmen found there was fault by a Council and a care provider with supervision levels. The care provider took action which remedied this issue satisfactorily. We found fault by a care provider with weight monitoring and foot care, but we were unable to say this caused an injustice. The Ombudsmen also found fault with how the care provider reported accidents involving a resident’s Motability car. The care provider has agreed to our recommendation that it makes a payment to address the financial loss an insurance claim would not cover.

    Summary: Miss B complains the Council did not properly consider her request for a discretionary disregard of the value of her grandfather’s home in its financial assessment. Miss B says the Council has not taken into account the level of time she spent and sacrifices she made to care for her grandparents, or that she gave up her home to do so. The Ombudsman does not find fault in how the Council considered Miss B’s request.

    Summary: Mrs X complained the Council placed her in unsuitable care homes in 2017. She also complained it failed to support her in her payment dispute with a care home in 2021. We found the Council at fault for its failure to properly consider and support her with her payment dispute with the care home it placed her in. The Council has agreed to apologise to Mrs X. We have not considered Mrs X’s 2017 concerns. This part of her complaint was late.
