  • Plymouth City Council (20 009 985)

Statement Closed after initial enquiries Refuse and recycling 16-Feb-2021

Summary: Mr X complains the Council inappropriately affixed a notice to his car which he had to clean off. Mr X also complains the Council failed to properly deal with his complaint about this. We will not investigate as the outstanding injustice to Mr X is not sufficient to warrant our involvement.

  • London Borough of Havering (19 005 325)

    Statement Upheld Other 15-Feb-2021

Summary: Mr X complained about how the Council responded to his reports of rats and drainage problems that affected his property. We have agreed with the Council’s previous assessment that there was some fault because it failed to carry out an inspection on one occasion and did not respond to some of Mr X’s complaints properly. To remedy the distress caused by these faults, the Council has already apologised and offered a payment to Mr X. We consider this to be a suitable outcome to remedy the injustice caused to Mr X.

  • London Borough of Hammersmith & Fulham (20 010 291)

Statement Closed after initial enquiries Other 15-Feb-2021

Summary: We will not investigate this complaint about the complainant’s request that the Council should ban people from walking dogs in public spaces. This is because there is insufficient evidence of fault and injustice.

  • Rugby Borough Council (20 002 659)

    Statement Upheld Pollution 15-Feb-2021

Summary: Mr and Mrs C complained the Council failed to properly respond and take appropriate action in response to their reports of nuisance from dust from the use of a neighbouring area of land as an overflow car park. Mr and Mrs C explained they could not enjoy their garden or open their windows and their property and car were regularly covered in dust. We have found fault by the Council in not investigating whether a statutory nuisance was being caused. We consider the agreed actions of an apology and an assurance about how future reports will be treated is enough to provide a suitable remedy.

  • Luton Borough Council (20 009 361)

    Statement Upheld Noise 15-Feb-2021

Summary: Mr X complains the Council did not properly deal with a planning application near his home and has not investigated concerns about noise and dust. The Council is at fault because it did not follow its complaints policy. Mr X cannot be clear how the Council is responding to his complaints. The Council has agreed to write to Mr X to clarify how it will respond to him and issue guidance to staff to ensure it follows its complaints policy.

  • Tandridge District Council (20 009 715)

Statement Closed after initial enquiries Noise 15-Feb-2021

Summary: Mr X complains about the Council’s handling of his complaints of noise nuisance from dog kennels near his home. We will not investigate the complaint because it is unlikely we can usefully add to the investigation already carried out by the Council in response to the 2019 complaint and it is open to him to co-operate with the Council with any new investigation into the matter.

  • Middlesbrough Borough Council (20 009 762)

Statement Closed after initial enquiries Refuse and recycling 11-Feb-2021

Summary: We will not investigate this complaint about a replacement bin because the Council has offered a remedy and there is not enough remaining injustice to require an investigation.

  • Transport for London (19 009 902)

Statement Closed after initial enquiries Licensing 10-Feb-2021

Summary: Mr X complains the Council will not give him a pro-rata refund for unused years on a private hire vehicle operator’s licence he took out with it. We will not investigate as it is unlikely we will find fault by the Council. Mr X’s complaint about the Council suspending his licence prior to this is outside our legal remit. This is because Mr X had the right to appeal against the Council’s decision in court.

  • Cheshire East Council (19 018 015)

    Statement Not upheld Other 10-Feb-2021

Summary: We found the Council was not at fault in deciding Mr X’s vehicle was abandoned and removing it from the public highway.

  • London Borough of Harrow (20 010 075)

Statement Closed after initial enquiries Other 09-Feb-2021

Summary: Miss X complained about the Council serving her with a Building Act notice for a drainage misconnection which she denies liability for. We should not exercise discretion to investigate this complaint. This is because it was reasonable for her to appeal against the notice to the Magistrates’ Court if she believed it was inappropriate.
