Summary: Mr X complains about the decision of his daughter’s care provider to withdraw her residential placement. He complains Leeds City Council was powerless to hold the care provider to account. He also complains about the Council’s handling of his complaint. The Ombudsmen finds fault with the Council. We have recommended Leeds Clinical Commissioning Group, as commissioner of continuing healthcare, apologise to Mr X and his daughter, and to pay them a financial remedy.

Summary: The Ombudsmen uphold Mr R’s complaints about his son’s access to therapy, the Council’s communication and delays with complaint handling. Mr R and his son suffered frustration, distress and they lost the opportunity to access therapy and respite. The Council and Trust agreed to apologise and provide a financial remedy to remedy the injustice they suffered. The Trust also agreed to implement systemic improvements.

Summary: The Ombudsmen found fault by the Council with regards to the care and support provided to a young woman with complex care needs. This fault meant the woman went without care for two years and caused both her and her mother significant distress. The Council has agreed to waive the outstanding care fees and pay an additional sum in recognition of the distress this caused for the woman and her mother.

Summary: We uphold Ms A’s complaints about a care provider not providing her with reading and social support. Ms A suffered avoidable distress and inconvenience and she did not receive the services agreed on her care plan. To remedy the injustice, the Care Provider will reduce the bill by a further £1500 and apologise for the failings identified within one month. We do not uphold Ms A’s complaint about billing her for a second carer.

Summary: Mr P complains about school transport for his son, R. I have decided not to investigate this complaint because Mr P has complained well over a year after he became aware of the matter and he could have raised it as part of earlier complaints. Mr P is pursuing a Tribunal appeal which could provide the school transport he seeks. Regarding his complaint about the way the Council handled the transport appeal, the Ombudsmen would not be able to achieve the outcomes Mr P seeks. It is also unlikely an Ombudsmen’s investigation would add to the response he has already received from the Trust.

Summary: Mrs D complained about the way the Trust, which was commissioned by the Council, decided to provide the speech and language therapy set out in her child’s education, health and care plan. The Trust did not follow the plan as set out but offered initial intensive support with a view to changing the plan. The Council had overall statutory responsibility for the plan and ensured it was not changed in line with Mrs D’s wishes. Mrs D wanted the Trust to carry out an equality impact assessment on its policy relevant for speech and language therapy. The Ombudsmen will not investigate this complaint as they cannot add to the investigation already completed.

Summary: Mrs B complains about a safeguarding alert raised by the Trust’s district nurses. She also says the Council’s safeguarding investigation was flawed. The Council and Trust have remedied any injustice to Mrs B. The Ombudsmen therefore will not investigate.
